FundView Website Terms of Use
These Website Terms of Use (the “Terms”) govern access to fundviewk12.com and public financial-information pages made available through FundView (collectively, the “Sites”). The Sites are provided by FundView Finance LLC, an Indiana limited liability company doing business as FundView (“FundView,” “we,” “us,” or “our”).
These Terms do not govern a school corporation’s subscription to the FundView software service or an authorized user’s use of that service. Those matters are governed by the applicable signed Order Form, Master Subscription Agreement, and Data Protection and Security Addendum.
1. Informational purpose
The Sites provide general information about FundView and may display financial-information pages that a school corporation chooses to publish for its community. FundView is a decision-support and communications platform. The Sites do not provide legal, accounting, investment, tax, or bond advice and are not a government filing or official accounting record.
2. District-published content
A school corporation controls the content it chooses to publish through FundView and remains responsible for reviewing and approving that content. Public pages may summarize or visualize information from the school corporation. Users should verify material figures against the school corporation’s official filings, board records, and other official sources.
The school corporation retains its rights in its data, name, logo, and published content. FundView retains its rights in the platform, page design, software, templates, and other FundView materials.
3. Acceptable use
You may view the Sites and share links to public pages. You may not:
- probe, scan, or test a Site’s security without FundView’s prior written permission;
- attempt to access an account, deployment, system, or data you are not authorized to access;
- interfere with operation of the Sites or circumvent technical restrictions;
- use automated means to scrape, harvest, or bulk-download content except with FundView’s written permission or as permitted by applicable law;
- misrepresent Site content or remove proprietary notices; or
- use the Sites unlawfully or to violate another person’s rights.
4. Intellectual property
FundView and its licensors own the FundView platform, software, designs, trademarks, and FundView-created Site content. Except for the limited right to access and use the Sites under these Terms, no rights are granted to you. District content remains the content of the publishing school corporation or its licensors.
5. Third-party links
The Sites may link to third-party websites or official sources. FundView does not control and is not responsible for those sites, their content, or their privacy practices.
6. Disclaimers
To the fullest extent permitted by law, the Sites are provided “as is” and “as available,” without warranties of any kind. FundView does not warrant that the Sites will be uninterrupted, error-free, or complete. Nothing in this Section limits obligations FundView separately undertakes to a subscribing school corporation in a signed contract.
7. Limitation of liability
To the fullest extent permitted by law, FundView’s total liability arising from a visitor’s use of the Sites under these Terms will not exceed one hundred dollars ($100). FundView will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Sites.
This limitation applies only to these Website Terms. It does not replace or reduce liability stated in a school corporation’s signed FundView contract.
8. Changes
FundView may update these Terms by posting a revised version and effective date. Changes apply prospectively when posted. Material changes will not amend a school corporation’s signed subscription documents.
